Deported Zambian businessman rejected in Rwanda, stranded at airport in Kenya

How long will Simwaya be allowed to hang around at this airport

The Zambian businessman Abdul Simwaya who was deported to Rwanda last week is stranded at Kenyata International Airport in Nairobi, Kenya.

According to his children in Zambia, the Rwandan government has rejected him as he is not their citizen.

The Zambian government bound Simwaya and put him on the first flight to East Africa without caring where it would land as they assumed he will go to Rwanda.

Simwaya came to Zambia when he was 15 years old 46 years ago. He is said to have no other national Identity documents apart from Zambian NRC and Passport.

On Thursday, 13th December, 2012, the Home affairs Minister Edgar Lungu deported Simwaya after accusing of being linked to Al Shabaab Terrorist Network.

Simwaya is a big businessman in Zambia and his deportation is part of the PF regime witch-hunt for any person believed to have connection to the opposition.

So far some businessmen have been deported to Italy and Nigeria.

Simple, the guy is not Zambia by Birth. The Guy came to Zambia when he was 15. Which means he came with a Passport issued by his country of Origin. Anyone even a 1month old gets a Passport to travel. Unless he was an illegal immigrant which makes his citizenship Null and void or he surrended/gave up his original citizenship and was given the Zambia citizen ship or he holds both?

International law states that if a person is deported from country A to country B, and then country B rejects that person, then automatically the person becomes a citizen of country A. Edgar Lungu as a legal counsel should have done his homework. instead of executing an act when parliament is in recess, very crafty!

I think PF bloggers can help you on this one. Their party has been deporting people left, right and center. Only in Zambia can this happen.

But who is promoting such barbaric kind of governance in the Zambian soil, does Zambia has a caring government by the way ? Deporting someone without a cause ? May Jesus Christ come back soon to judge these fools who think they are now gods since they are in government.

    • zambian   December 18, 2012 at 08:24

I totally agree on Gunasse and Fawaz and any other foreigner who thought by paying politicians they had a blank cheque. It will not help you by crying out too loud. If you are not a Zambian, you are not.
Please PF nabakateka, give the Zambian people the dignity MMD denied us for so long.

  22. Michael Chilufya Mumembe   December 18, 2012 at 03:04

ATT EDGAR LUNGU.I think the Zambian govt got it wrong again. This man was given Zambian citizenship and thus, he is a Zambian. if truly he was supporting Al Shaabab, he should have been charged for that wrongful act and taken to court as a Zambian. If Guy Scott or his children commit a wrongful act before the courts of law, is the Zambian govt going to deport him to the UK or take him to court as a Zambian? What Edgar Lungu and some of his lieutenants don’t know is that once one is given citizenship, origin does not matter. When one commits a crime or a tort anywhere on earth, he will be tried as a citizen of that country, and not as citizen of the country of origin. So, let him comeback and be tried in Zambia for the alleged crime because he is a Zambian. Remember, when the famous Clarke was threatened with deportation by the MMD govt, he laughed and told them to deport him to LIVINGSTONE.

  23. Nameless   December 18, 2012 at 01:07

Shocking beyond belief! A country deporting its own citizen? This is a huge step backward. When I heard that Zambia had a Caucasian vice president I said to myself, “Here is a forward-thinking country!” I take my words back.

Mubanga Martin. You are an embarrasment to education. What alien when the man is a Zambian? Anyone who takes up Zambian Citizenship ceasees being a foreigner, especially that Zambia does not provide for duel nationality.

  35. Bob   December 17, 2012 at 20:11

Sober up Mubanga Martin, sober up. Simwaya is married to a Zambian and that alone makes it possible for him to apply for citizenship. Simwaya never used any shortcuts in obtaining his Zambian citizenship – HE IS ZAMBIAN PLEASE. It is you who should read the constitution to fully understand its provisions, it seems you just have some idea but not the specifics.

  36. Roosevelt   December 17, 2012 at 19:42

I want to believe that the government of the day does consider other avenues available before a deportation is effected. If not, my appeal to you Mr. President (being the father of this land) consider taking them to court and let the law take its action. Am 100% positive that a peaceful and amicable way of dealing with these people (considered to be foreigners) can still be found, even before a deportation is effected. Long life Mr. President as you lead Mother Zambia.

    • Zed spectator   December 18, 2012 at 07:38

Mr. President being the father of this land???? I don’t think so. God is the father of this land.

      • Roosevelt   December 18, 2012 at 16:16

I hope you know what you are talking of. Am not here to debate cheap politics with you. For sure i would not compare the President with God. If you do not consider the head of state as the father of the nation, then i do not know what your beliefs are. With due respect, i appeal to you, to please respect the people in authority. I thank you.

Oh! My God! For how long shall we demean the values of humanity just for our selfish interests. God in heaven, deliver us from crooked and selfish leadership that does all to their survival. They trump upon others feet and sit on their heads to sustain their livehood.
My God, this is not new to our country. We have witnessed the declaring of KK stateless all for political gain. Lord, deliver all the deported from the hand of oppressors and avenge in accordance with your word.
Rupia Banda was declared Zimbabwian, Chiluba was said to be Congolese and SATA is speculated to be Tanzanian and the list is endless my lord. Are we not all migrants from some where? Blessed are those that claim to have fallen from heaven. Not possible to deport them.

    • Mohammad Harun-Or-Rashid   December 17, 2012 at 19:25

In that case the Sata Govt. will kill them to deport to heaven.
      That would be easier.

    • Zaza   December 17, 2012 at 19:04

Its the way it was done which is wrong. Any government is supposed to protect its boarders from illegal foreigners.

However when done wrongly to fix the opposition, it ceases to be right.

This man was ACCUSED and not proved to be illegal citizen.

Even an illegal foreigner has some basic rights.

    • Kamalondo   December 18, 2012 at 07:35
