70-year old Nakonde man convicted for defiling 14-year grand daughter

Nakonde magistrate court in Muchinga Province has committed a 70- year- old man of Nakonde to the High Court for sentencing after he was found guilty on charges of defilement contrary to the laws of Zambia.

Appearing before magistrate John Kajiko Njapau for judgment yesterday was Simon Sichone of Chozi village in Chieftainess Nawaitwika’s area charged with one count of having carnal knowledge of a girl under the age of 16 years, contrary to section 138 CAP 87 of the laws of Zambia.

Facts presented before the court were that on May 20 this year, Sichone was arrested by the police after he was reported to have defiled a minor of the same village.

It was reported that on the date mentioned above, Sichone sent his granddaughter to look for relish in his Cassava field which was far away from the compound.

Sichone later followed the girl and defiled her, in the cassava field.

Sichone allegedly threatened to bewitch the minor if she tried to scream for help.

However when the girl went back home she reported the matter to her mother who further reported the matter to the police.

Sichone pleaded not guilty to the charge.

Passing judgment, magistrate Njapau said considering the evidence induced before court by the state witnesses it was proved beyond any reasonable doubt that the accused committed the offence as charged.

The Magistrate further said that he had found Sichone guilty as charged and convicted him accordingly.

The Magistrate also said that he had taken into consideration what the accused had said in mitigation but that due to the gravity of the offence committed he was going to refer him to the high court for sentencing.

In mitigation, Sichone said he was looking after three orphans who would suffer if he was given a custodial sentence.

Sichone also said that he was an old man with only few years to live on earth and asked for maximum lenience to be exercised on him when sentencing him.
