Three Lusaka High Court have quashed former Labour Minister, Austin Liato’s two years conviction for possession of K2.1billion in the old currency, suspected to be proceeds of crime.
Mr. Liato was arrested and convicted by the Magistrate Court for being in possession of K2.1 billion cash that was found hidden at his farm and the state repossessed both his money and seized properties.
But delivering judgement today, three Lusaka High Court Judges, Mwiinde from Ndola High Court, Sharp and, Chalwe Mchenga ordered that Mr. Liato be given back all his money and the properties that were seized by the joint investigation team comprising the Anti-Corruption Commission (ACC), Zambia Police and the Drug Enforcement Commission.
The three Judges ruled that the magistrate errored in convicting Mr. Liato as there was no complainant on the matter, among other reasons.
This now means Mr. Liato, who was represented by Mutemwa Chambers and Associates, is a free man who will immediately offload K2.1 billion of old currency in circulation, just in time for christmas.
