Case of fraudulent judge Nkonde takes new twist

The matter in which Lusaka High Court Judge Sunday Nkonde obtained a dubious Consent Judgement to avoid being suspended has taken a new twist. The Judicial Complaints Commission has disassociated itself from the judgement and has since written to Attorney General Likando Kalaluka .

According to sources from the JCC, Solicitor General Abraham Mwansa who signed the consent order while the Attorney General was on leave committed a Professional misconduct because he did not get instructions from his clients in this case the JCC. ”

Here is the anomally. Clients give instructions to lawyers. If the client and lawyer do not agree, the lawyer recuses him or herself. In this case as you can see from the Consent judgement, Makebi Zulu’s client is Sunday Nkonde. Attorney General’s clients should be JCC but we never gave those instructions, ” the source said.

The source said it is an open secret that Abraham Mwansa and Lewis Mosho are close friends hence the hurriedly obtained consent judgement.

” Why the rush. The AG was on a very short leave with the magnitude of this matter, they could have waited for the substantive Attorney General to get the office, ” the source said.

The source further stated that had it been during the reign of late President Levy Mwanawasa, the Solicitor General could have been fired.

” It is the JCC that recommended that the President sets up a tribunal to investigate Judge Nkonde over his conduct on the liquidation of the Post Newspapers. Nkonde got a stay against JCC. This means that the Attorney General’s client JCC and it is JCC to instruct the Attorney General. We are the clients and we did not give those instructions and we have sinve written to Attorney General” the source said.
