Con Court overturns High Court ruling, declares Nkandu Luo duly elected


As was expected, the ‘compromised’ Constitutional Court has declared that Nkandu Luo was duly elected Member of Parliament for Munali constituency.
The Con Court set aside the earlier nullification of Prof Luo’s election just like it did a few weeks ago in the Lusaka Central Constituency case involving Finance Minister Margaret Mwanakatwe.
Constitutional Court Judge Enock Mulembe upheld Prof Luo’s grounds of appeal against the High Court judgement noting that for an election petition to succeed, the petitioner needs to adduce evidence to the highest standard of proof further adding that the standard of proof must be substantiated.
Prof Luo’s election was nullified by the Lusaka High Court Last year on allegations of electoral malpractices and violence as was petitioned by UPND candidate Doreen Mwamba.
