Magistrate Lameck Mwale has discontinued the case in which the PF and Rupiah Banda are trying to ‘fix’ and hound out of office DPP Mutembo Nchito.
In discharging Nchito,Magistrate Mwale said the DPP has power to stop any criminal case against anyone in Zambian including himself.
Nchito was briefly arrested last week on nine charges, including abusing his authority, contempt of court and fraudulent contracting of debt. The offences were allegedly committed between 2008 and 2013.
But when he was taken to court, he entered a nolle prosequi in favour of himself.
“I am the director of public prosecution of the republic of Zambia and I have decided to enter a nolle prosequi against all the charges,” Mutembo Nchito told the magistrate from the dock.
Magistrate Lameck Mwale then adjourned the matter so that he could consider whether a DPP is legally allowed to stop a case against himself.
Nchito is prosecuting Rupiah Banda for the corruption he is believed to have committed when he was entrusted with power to rule Zambia.
