Justice Permanent Secretary Joseph Akafumba on Tuesday attempted to physically harm lawyer Nelly Mutti following exposure that he and Minister Wynter Kabimba are defrauding retired civil servants.
The Watchdog on Tuesday reported how Akafumba (in the photo below), Kabimba and their partner Rabson Malipenga criminally transferred a payment file for Voluntary Separation Association of Zambia (VSAS) from Lukona Chambers owned by Nellie Mutti to Rabson Malipanga’s law firm without the consent of the 3568 retirees.
Mutti won the case for the retires.
The Watchdog explained how Malipenga fraudulently deducts 15 per cent from each retiree’s payment every month then shares the money with Akufumba and Kabimba.
A few minutes after reading that expose, Akafumba phoned Nelly Mutti and asked her to meet him at his office.
‘At the office, Akafumba rained insults on Nelly and charged toward her to attack,’ said a source.
Akafumba accused Mutti of leaking the story to the Watchdog.
According to people who witnessed the event, Akafumba was physically restrained by junior workers from attacking Mutti.
In the scandal, Akafumba, kabimba and Malipenga are working in collaboration with a Mr. Siachoke Simazeza the Chairperson for VSAZ who replaced late Nasando Isikanda. He is believed to be an ex-convict.
State agents were used to steal documents from Lukona Chambers.
In appreciation, Malipenga has offered free legal services to Wynter Kabimba during the tribunal, which is currently probing Kabimba.
Malipenga is one of the lawyers who on Monday failed to cross examine former Solwezi Central Member of Parliament Lucky Mulusa after Mulusa sowed that Kabimba obtained pecuniary advantage when he obtained legal advise from the Solicitor General that benefited his political party.
“We will soon be writing to the Law Association of Zambia to discipline all the three because they are all lawyers. It is not only criminal but also unprofessional. It was Nelly Mutti who represented those people in court and the Judgement went in favour of Lukona Chambers not Rabson Malipenga. So LAZ has to play its part and the Police and the ACC have to play its part,” the source said.
