For third time, court refuses to stop Zambezi west bye-election

 

A Lusaka High Court has thrown  out an application by the PF to stop the forthcoming Zambezi West by-election.

Judge Judy Mulongoti threw out the application after the Respond’s lawyers Gilbert Phiri of PNP Advocates and Keith Mweemba of Keith Mweemba and Company successfully argued the case. The PF Zambezi West losing candidate Christabel Ngimbu had argued that she had filed in an appeal in the Supreme court against Charles Kakoma from standing as such the High Court should stay the elections.

However, Gilbert Phiri and Keith Mweemba argued that in the Sonny Mulenga versu s Investrust bank case the Supreme court ruled that an appeal can not act as a stay.

Electoral Commission of Zambia through its lawyer Erick Kamwi also told Judge Judy Mulongoti that the September 11 elections should go ahead because the probability of convinience weighs towards having elections. Mr.Kamwi said the ECZ has already printed election materials.
