The summons have already been served on Kabimba.

In a statement of claim, GBM says he has never been charged formally as he like any other person just read in the press that he was suspended, charged and expelled.

He further says that he was given an opportunity to choose between Chitimukulu a family member and a cabinet position but he chose his family.

Further the statement of claim filed by his lawyers Makebi Zulu Advocates says procedure was not followed.

The Northern Province Patriotic Front committee expelled GBM yesterday.

As it stands, GBM remains a Member of Parliament for Kasama and a member of the PF until the matter is determined by the High Court.
