High Court dismisses Muvi TV and Komboni Radio appeal

The Lusaka High Court has dismissed an appeal by Muvi Television and Komboni Radio against the suspension of their broadcasting licenses by the Independent Broadcasting Authority Board.
This is in a matter in which Muvi Television and Komboni Radio have dragged the Independent Broadcasting Authority and the Zambia Information and Communications Technology Authority to Court over the suspension of their broadcasting licenses for alleged professional misconduct.
In dismissing the appeal by the two media institutions, High court judge Mwiinde Siavwapa said the application for a mandatory injunction was ill fated.
Justice Siavwapa in his ruling said the application was also misconceived and incompetent and that the two media institutions used wrong procedure to try and challenge the suspension of their broadcasting licenses.
Justice Siavwapa notes that the application for an injunction does not constitute a standalone cause of action.
The IBA recently suspended the broadcasting licenses for Muvi TV and Komboni radio for alleged professional misconduct.
