High Court rejects application by Kambwili and Garry Nkombo to be joined to judicial review on impeachment case

The Lusaka High Court has refused to join Garry Nkombo and Chishimba Kambwili to the judicial review proceedings challenging the Speaker’s decision to entertain the impeachment motion.
The court refused to join the duo on grounds that they, despite being movers of the motion, do not have sufficient interest to warrant them being joined.
The court was further of the view that by seeking impeachment on matters that are before the Constitutional court, the two, Gary Nkombo and Chishimba Kambwili were forum shopping and so should not be joined to the judicial review.
In arriving at the decision, the court made no mention of the other grounds contained in the impeachment motion that have nothing to do with the cases that are said to be pending before the Constitutional court like the corruption allegations levelled against the head of state.
The Attorney General and the applicants for judicial review are now free to conduct the matter in whatever way they wish to do, including entering into a consent order to have Parliament not to entertain the impeachment motion.
