Prominent lawyer Martha Mushipe says the judgment by the Constitutional Court that ordered former ministers to vacate offices and refund all the money they illegally acquired means that their parliamentary seats can easily be nullified if any of them will be re-elected on Thursday.
Commenting on the gravity of the judgment by the Constitutional Court, Mushipe said ‘It simply means anyone who loses to someone who was a minister or deputy minister can petition the Electoral Court to nullify such a victory,’
She explained that ‘going by the CC ruling such a victory would be nullified, given that they (former PF ministers) campaigned using illegally acquired Government resources’.
‘Further’, Mushipe said, ‘the constitution says a person whose election is so nullified is not eligible for re-election’
She said that simply means anyone who was in Lungu’s last cabinet that is seeking re-election may end up in the cold.
