LAZ appeals, insists Chibesakunda is illegal chief justice

The Law Association of Zambia (LAZ) through its lawyers Makebi Zulu Advocates has applied for leave to appeal against the decision by Kitwe High Court Deputy Registrar Charles Zulu to dismiss a petition to declare that Acting Chief Justice Lombe Chibesakunda is acting illegally.

According to an Affidavit in support of Exparte Summons filed in the Lusaka High Court by George Chisanga the LAZ President, LAZ says it is dissatisfied by the decision of then Kitwe High Court Deputy Registrar Charles Zulu who dismissed the petition on grounds of procedure impropriety.

“The plaintiff being dissatisfied with the ruling is desirous to appeal against the said ruling of this honourable to a Judge in Chambers'” the affidavit reads in part.

The affidavit further states that the plaintiff’s appeal has very high prospects of succeeding as the plaintiff do verily believe that the honourable district registrar erred fundamentally when he dismissed the writ of summons and statement of claim attendant there upon on the grounds contained in the ruling of the court and the plaintiff therefore applies to this honourable court for leave to appeal against the said ruling.
