LAZ says manoeuvres by law enforcement agencies and a Chongwe magistrate to arrest Director of Public Prosecutions Mutembo Nchito in disregard of the law is immensely shocking. And LAZ also says Nchito’s arrest sets a very dangerous precedent in the handling of cases of alleged impropriety and misconduct against holders of constitutional offices. Commenting on Nchito’s arrest on Thursday after a Chongwe magistrate issued a warrant of arrest against him, Law Association of Zambia president George Chisanga said they expected President Edgar Lungu to intervene.
“LAZ expects that the President will intervene in this threat to due process and constitutionalism, which has potential of setting a very dangerous precedent in handling of cases of alleged impropriety and misconduct against holders of constitutional offices,” Chisanga stated. He stated that LAZ was deeply concerned about the events surrounding the DPP over the last two days. Chisanga stated that the reported manoeuvres by the law enforcement agencies in executing an arrest warrant against the DPP, which was issued in disregard of the law and his subsequent arrest in clear contravention of the High Court order staying the execution of the arrest warrant, had come to the association with a sense of immense shock. He stated that the filing of criminal charges against the DPP on the grounds that had been made public was unprecedented in the nation.
