Magistrate issues bench warrant against Kitwe Deputy Mayor

Kitwe Resident Magistrate Daniel Musonda has issued a bench warrant against Kitwe Deputy Mayor Francis Miti for failing to turn up for trial in a case where he is alleged to have assaulted his wife Suzanne Kapemba and her elder sister Maggie Kapemba.

This is in a case where Mr Miti is alleged to have severely beat up his wife, Suzanne Kapemba and assaulted his sister-in law Maggie Kapemba when she tried to separate the two.

Mr Miti, who is Patriotic Front (PF) Wusakile ward councilor, pleaded not guilty to the offense of assault on April 23, 2013 and was expected to turn up for trial today.

But, Mr Miti together with his surety, Mr Webster Malama who is also PF ward councilor for Chibote ward, failed to turn up for trial, prompting the court to issue a bench warrant against him.

Prosecutor Chilufya Mulenga applied for a bench warrant against the Kitwe Deputy Mayor after he was convinced that the accused had not turned up for trial.

“Your honor, the accused person has not come and even the surety has not come. So am applying for a bench warrant against the accused person. The case was set for trial today,” said Mr Mulenga said.

And in response, Magistrate Musonda granted the application for bench warrant against the Kitwe Deputy Mayor.

“The application for bench warrant is granted, ” said Magistrate Musonda.
