A witness has told the Lusaka Magis-trates’ Court how a 10-year-old boy told her that a man had allegedly sodomised him, according to the Post newspaper
In this case, 37-year-old Lovemore Tuyashi of Mtendere compound is charged with two counts of unnatural offences contrary to the Laws of Zambia.
In count one, it is alleged that Tuyashi on November 21, 2010 in Lusaka had carnal knowledge of a boy aged 10 against the order of nature.
On the second count, Tuyashi is charged with an unnatural offence contrary to the Laws of Zambia as read together with Act number 15 of 2005.
It is alleged that Tuyashi on November 21 last year had carnal knowledge of another boy against the order of nature.
After denying the charge, the court entered a plea in that respect but the state applied that his bond conditions be reviewed.
In reviewing the said conditions, principal resident magistrate David Simusamba substituted the bond with a K10 million bail in his own recognisance with two working sureties.
And testifying in the matter on Thursday, Sarah Mundundwe recalled that on November 21 last year, the first victim went and told her that Tuyashi had sodomised him.
Mundundwe said the victim told her that Tuyashi did the same thing to his friend who is also 10.
She told the court that the first victim narrated to her that on the material day, Tuyashi sent him juvenile to go and buy him beer and that when he came back with the beer, he was told to go into the accused’s bedroom where he was sodomised.
Mundundwe added that the victim told her that after Tuyashi sodomised him, he warned him not to tell anyone what he had done to him.
Trial in the matter is expected to continue on June 13.
