KAFULAFUTA member of Parliament George Mpombo is no longer a member of the party and his name has been deleted from the register, MMD acting national secretary Chembe Nyangu says.
Mr Nyangu said in an interview yesterday that Mr Mpombo has joined the opposition and has, therefore, ceased to be a member of the ruling party
Recently, the Lusaka High Court dismissed Mr Mpombo’s application for an injunction to restrain the MMD from asking the Speaker of the National Assembly to declare the Kafulafuta Constituency seat vacant, following his expulsion from the party.
Mr Mpombo had argued that the grounds of the expulsion lacked merit.
Lusaka lawyer Keith Mukata of AKM Legal Practitioners represented the MMD in the case. The former Minister of Defence had sued Mr Nyangu and Attorney General Abyudi Shonga as first and second defendants, respectively.
In his application, Mr Mpombo asked the court to declare his expulsion from the ruling party null and void.
Mr Mpombo was initially granted an interim injunction to restrain Mr Nyangu from informing Speaker of the National Assembly to declare the seat held by the MP vacant.
“At the time Mr Mpombo was making this court application, he was not even our member. He is no longer in our register because he is a member of the opposition,” Mr Nyangu said.
Mr Nyangu said Mr Mpombo has made several negative statements against the party he wants to hold on to, even when he has been publicly seen on many occasions in the company of the opposition.
In her ruling dated November 30, 2010, Ms Justice Florence Lengalenga said the MP had failed to satisfy the court on his right to relief and how he was likely to suffer irreparable damage or injury if the injunction was not granted.
The application was dismissed with costs. Mr Mpombo was unavailable for comment as he was reportedly attending a lecture.
