An investigation has been launched into allegations that Lusaka businessman Mohamaad Salama tendered a fake medical report in the High Court last week.
Salama may face charges of perjury (lying in court) and/ or contempt of court if it is proved that he submitted a fake medical report.
This is in a matter in which Salama and others have been sued by Finance Bank Zambia Limited to pay back $36 million plus as at September 2012, which they admitted borrowing from the Bank despite previously pleading fraud, forgery etc.
The Bank’s lawyers are also seeking redress for false pleadings.
A letter written by Salama’s lawyers Sakwiba Sikota S.C. (who is also a Director of the Companies involved) on 20 November, 2012 admitted that Salama, Ody’s works and Hottellier owe Finance Bank $26, 635, 740 (26 million, six hundred and thirty-five thousand US Dollars) as at September 2012. They only disputed the interest computation as explanations for the difference in the Bank claim and their computations prepared by their Consultants.
They were trying to settle this matter out of Court in what they said was without prejudice to the on-going court cases and in so doing admitted the claims and promised to pay within six months of the date of their letter.
The Bank (through their lawyers) were prepared to accept the admitted sum allowing the Courts to determine the difference.
But this approach failed.
When the matter came up on Thursday last week, Salama’s lawyers submitted that their client was not available in Court because he had fallen ill and was ordered by doctors to remain in hospital in Egypt for six weeks.
According to papers submitted in Court, Salama has repeated bolts of fever, has renal stones on both sides and had undergone a medical operation.
But the medical report is been viewed with suspicion and considered to be a fake. Suspicion has arisen that Salama came up with a fake medical report (a few days before the Case) because he has nothing to say to defend himself in Court and answer to the many false allegations he created with his perpetrators.
