Chilanga Member of Parliament Keith Mukata has filed in a notice of appeal against his conviction.
According to a notice of appeal filed in the Court of Appeal Criminal Jurisdiction, Mukata has argues that the High Court judge erred in Law and fact when she convicted him without his supporting evidence on record to support such a conviction.
He says, ‘the learned trial judge erred in Law and fact when she convicted me based on circumstantial evidence which had more than one inference to drawn therefrom.”
Yesterday Lusaka High Court Judge Susan Wanjelani sentced Mukata to death after finding him guilty of first degree murder.
However, Mukata’s coaccused Charmaine Musonda was acquitted on all charges of murder.
In this matter Keith Mukata was convicted for one count of murder.
The convict murdered his Security guard Namakau Kalilakwenda who was manning his Law firm on May 6, 2017.
Judge Wanjelani said there was conflict between where the firearm and keys of the BMW were found.
She said the burden to prove the case beyond doubt does not lie with the accused.
