A Lusaka High Court has allowed a judicial review of the decision by the Director of Public Prosecutions (DPP) to withdraw an appeal against former president Frederick Chiluba’s acquittal.
Munali Patriotic Front Member of Parliament Mumbi Phiri applied for a judicial review when Chalwe Mchenga withdraw the notice of appeal after Chiluba was acquitted of six counts of theft.
MP Phiri cited the DPP and Attorney General Mumba Malila as the first and second respondents respectively.
On September 8, 2009, judge Phillip Musonda stated that he would grant leave but said he would not order that the Notice of Appeal be restored.
The matter will be heard on September 18, 2009.
