A State Advocate has clearly committed contempt of court by demanding that all lawyers representing Hakainde Hichilema in the matter he has dragged Religious Minister to court for contempt surrender evidence to him.
Chimbeka Sakala a State prosecutor Wednesday delivered letters to all lawyers representing Hichilema directing that they surrender the evidence to the Director of Public Prosecutions because she has taken over the matter.
Sakala further in his letter threatens that another course of action will be taken if the lawyers do not surrender the evidence.
This is despite the fact that Lusaka Magistrate Ireen Washimanga has not yet ruled on the application by the DPP to take over the matter.
” Yes this young man who is just two years at the bar has written to all of us directing us to surrender evidence of our client against Minister Sumaili to the DPP. How do we do that when the Magistrate has not ruled over the application. Both parties were asked to make submissions and the matter is coming up on August 28,” the source said.
The source wondered where the country was heading to.
” Surely where is this country going to
if a junior officer can use the DPP’s name to openly committ contempt of court. So it simply shows the state advocate has no regard for the magistrate. Why not wait for the court to render a ruling? What is happening in this country?” the source asked.
