The state has again abused the court processes by entering a nolle proseque on a case in which the UPND President Hakainde Hichilema and his co-accused are alleged to have blocked the presidential motorcade carrying Edgar Lungu along Mongu -Limulunga road.
When the matter came up for hearing on this charge before magistrate Greenwell Malumani, the state entered a nolle proseque meaning they have discontinued the traffic offence charge.
But of interest is that this is the same traffic offence that Mr. Hichilema and his co-accused are alleged to have committed treasonable offence in other case under another magistrate as amended into an overt act.
This just shows that Edgar Lungu just wants to maintain the treason charges on Mr. Hichilema as a way to keep him in filthy prison detentions until the matter is disposed off.
Had this matter of traffic offence been maintained, Lungu’s lawyers were expected to bring in basically the same witnesses as in the treason case which is still hanging on Mr. Hichilema.
And these witnesses would have testified how Mr. Hichilema committed the alleged offense of blocking Mr. Hichilema and how this amounts to a case worth pursuing.
As it stands, Mr. Hichilema still remains in detention over this traffic offence which was amended as an overt act.
And since treason charges are not bailable, this same traffic offence amended to be an overt act before Magistrate David Simusamba will mean Hichilema remains in detention.
Tomorrow morning, Mr. Hichilema and his co-accused go back to court on this same so called traffic offence.
