The ruling PF government have recommended that former deputy Chief Justice and current Electoral Commission of Zambia (ECZ) Chairperson Ireen Mambilima be realigned and sent back to the Supreme Court bench.
Reports reaching the Watchdog indicate that Acting Chief Justice Lombe Chibesakunda may also be recommended for ratification for confirmation as Zambia’s Chief Justice.
Sources within the PF government revealed that Ms. Mambilima has since reluctantly accepted to go back to the Supreme Court bench because that is tantamount to demotion and unconstitutional as she left the full-bench as Deputy Chief Justice.
Sources have revealed that the changes would have been effected immediately but Parliament has to ratify the appointment of Ms Chibesakunda.
And a source at Parliament has confirmed that State House has written notifying the legislature on the nomination.
The parliamentary submissions on ratification of Mrs. Chibesakunda’s appointment will be heard from February 4 and 5, 2013.
A Cabinet Officer source says it is a scandal for President Sata to appoint Mrs. Chibesakunda as Chief Justice because she has already passed retirement age.
The source said there was a Supreme Court ruling that says a Supreme Court judge who has reached retirement age can not be brought back to hold a position higher than previously held.
The source said President Sata has finally succumbed to a private newspaper editor who wants a user friendly Chief Justice.
