Sodomy accused found with case to answer

A 28 year old man of Chipata compound in Lusaka has been found with a case to answer and put on his defense for having canal knowledge of an 11 year old boy of the same area.

Alfred Mwewa is charged with unnatural offenses against the order of nature contrary to the laws of Zambia.

When the matter came up for continuation of trial before Resident Magistrate Aridah Chulu today, the state prosecutors informed the court that they had two witnesses to testify in the matter.

And one of the witnesses, the mother to the victim, Charity Mumba told the court that her son came home crying on the material day and told her that Alfred had taken him to the rail line where he had sexually abused him through the anus and that when she checked him, she found cuts on the anus.

She testified that she then reported the matter to Chipata Police Post where her son was issued with a medical report which was then taken to University Teaching Hospital.

She said her son was admitted for a night while getting medication.

And a police officer Sianga Mushiba, from Chipata Police Post, said when she reported for duty on August 30, 2013, she was given a docket where Charity Mumba was complaining that her son was sexually abused through the anus.

Ms. Mushiba said she later discovered that the accused person was already in custody.

She said she charged the accused for the offense in question after he failed to give a satisfactory answer under a warn and caution statement.

She told the court that she found two medical reports in the docket which she tendered before the court to be part of the evidence.

The state then told the court that they were closing the case as they had no more witnesses to testify in the matter.

Magistrate Chulu said she had put the accused on his defense because she had found him with a case to answer.

But the accused person, Alfred Mwewa told the court that he would bring one witness.

The magistrate adjourned the matter to March 6, 2014 for defense while Mwewa has remained remanded in custody.
