UPND to seek judicial review in Masebo Zawa corruption

UPND intends to seek judicial review over the failure by the Acting Chief Justice Lombe Chibesakunda to constitute a tribunal against Arts and Tourism Minister Sylvia Masebo following allegations of corruption and abuse of office in the manner she canceled Zambia Wildlife Authority (ZAWA) tenders.

UPND Chairperson for Tourism and Culture Ephraim Belemu said the delay by Justice Chibesakunda to constitute a tribunal to investigate corruption and abuse of office allegations leveled against Masebo was suspicious and irregular.

Belemu said Acting Chief Justice Chibesakunda was compromised and her continued stay at the helm of the judiciary had proved costly to the justice system of the country.

He said his party was worried with the conduct of Justice Chibesakunda who instead of informing President Michael Sata about the development had opted request a meeting with the petitioner William Harrington, former Tramsport Minister in the MMD administration.

He said it was now clear that the judiciary with Justice Chibesakunda at the helm of the system was highly compromised and corrupt, adding that his party would soon seek legal interpretation on the matter.

Belemu said Justice Chibesakunda should redeem herself from allegations of compromise and abetting wrong doers by carrying out the obligation of the office of the Chief Justice as enshrined in the laws of the land without favours for those in power.

“We are worried as a party with the conduct of Acting Chief Justice Lombe Chibesakunda in the manner she is handling the petition for a tribunal to investigate Sylvia Masebo for corruption and Abuse of office allegations in the manner she canceled the Zambia Wildlife Authority (ZAWA) tenders.

“It is extremely shocking that Madam Chibesakunda is behaving in a very suspicious manner by requesting Mr. Harrington for a meeting over the petition. We take her action unkindly because she has only shown how defensive she is over Masebo,” he said.

Belemu, who is UPND Mbabala Member of Parliament, said his party would soon be meeting Harrington to discuss the matter further before applying for a judicial review over the action by Justice Chibesakunda.

He said that the law was very clear on the requirement to constitute a tribunal and that it was shocking that the Acting Chief Justice was protecting wrong doers by not responding to the dictates of the law.

Belemu cited the Remmy Mushota tribunal and the most recent one involving Dora Siliya which was constituted after complaints from members of the public were made available to the Chief Justice.

He said it was highly irregular and irresponsible for the Acting Chief Justice to start organizing meetings with petitioners when she was supposed to inform the President about the constitution of a tribunal to investigate the corruption allegations.

“I am sure if it was someone else who is from the opposition, a tribunal could have been constituted without fail and this matter would have been history by now. And these are the double standards that we have been talking about in the dispensation of justice in this country. But we have to warn her that as a party we have remained without an option but to push for a judicial review,” he said.

Belemu reminded Justice Chibesakunda that it was her obligation to ensure that legal provisions of the law were met and delivered accordingly without looking at the face.

Harrington has since urged the Civil Society Organisations to support and join the tribunal proceedings to investigate allegations of abuse of office levelled against Ms. Masebo.

In his invitation letter to the CSOs, Harrington said, “The purpose of writing to you this letter is to invite other Civil Society Organisations (CSO) to consider joining the proposed tribunal proceedings as was the case in the Dennis Chirwa-led tribunal appointed to investigate Ms Dora Siliya MP in the matter of Zamtel sale and International Airport radar contract,” part of the letter read.

    I remember an NGO called Not So Transparent International Zambia making all sorts of noise about Dora’s Tribunal. Today they are so quiet, quietly chewing not only foreign tax payers’ money, but our tax payers’ money as well. Lungu is quietely and patiently waiting for a job like his friend Lifuka was rewarded.

    Justice Lombe Chibesakunda is not “Acting Chief Justice” from the day Parliament rejected her ratification by voting against her. Let her retire peacefully. There is nothing pending for her because her name cannot be resubmitted to Parliament.
    Remind the appointing authority to appoint someone else to set up a probe team against Hon. Sylvia Grand Mummy.

    Well, it’s a Catch 22 conundrum isn’t it. You want to seek judicial review to probe her, but she is the head of the judiciary, so who is going to grant to independently and impartially grant this judicial review? That’s why some offices must be honourable and remain apolitical and above board.

    What does the law say about the process of hounding out of office a corrupt Chief Justice if they can’t resign on moral grounds and public interest?

    Madam Chief Justice, the tribunal is too long overdue! All CSO must put their pressure on her because must be given opportunity to be heard. They well quick in removing RB’s immunity but they don’t want to be accountable. What kind of ‘fight against corruption’ is that? Tribunal now!!!

      Hey u they can be if their offer is far much better than that for Zambians. If Zambians are not participating at all or if their offer is far too less. ZAWA need revenue to manage Natural Resources for the good of the national and not merely to please you. Nothing strange here. Ask yourself why the acc can’t give you feed back on their findings after invading ZAWA offices for a week. Remember this is now the fourth months from the time ZAWA bosses were fired for allegedly corruption but upto now are not arrested. Situation is even worse in ZAWA as there are even no salaries for their workers. ZAWA staffs not paid for February, March and now April??? Think of operation funds, no money and poachers now taking advantage

    Masebo argued that the reason why she fired ZAWA guys was bcoz of corruption, she was quick to fire the guys, i beleive since Mr harrington suspect corruption on the part of Ms Masebo, the same impulse of reaction should be applied by Acting Chief justice or is int chief injustice

    These judges need a govt that can come to piss on them after the govt they support leave office.
    I dream of a govt that will come for the poor not this govt that has been hijaked by mumembe, masebo bank, nchitos & mahtan. These merceneries were never nearby pf. Today, they borrow fraudlently & walk out of the court trying them with iimpunity.
    With a military govt, these merceneries with their corupt chief judge need hanging

    What Harringtone isn’t saying is that Slyvia Murambiwa is guilty. He’s saying there are ALLEGATIONS which must therefore be investigated. Is there anything wrong with that? Or the Acting Chief Justice hasn’t been granted permission by the nephew or cousin President? As long as the three Heads of organs of Government are compromised, the nation is going nowhere, its under siege. And so far Sata, Matibini and Chibesakunda have nothing to show for it. The regional commentators have began to call us a failed state and a Banana Republic. Can you blame them?

      Harrington is not saying Sylvia is ‘guilty’. He is saying he believes Sylvia misapplied herself and abused her authority in cancelling those tenders (inter alia) and, therefore, there is need for a tribunal to be constituted to investigate… Have clarity of thought and please do not mumble jumble lest you lose your point!

    She is just a bootlicker and blind PF follower without respecting the laws of our judiciary.
    For how long is she going to be acting Chief Justice since parliament refuted to ratify her as per request of the PF president?
    Madam Chibesakunda, respect the justice system or serve face and retire as your failure is beyond measure.
